Terms of using the Free Consultation contact form

§1 General provisions

These "Terms of using the Oversec Contact Form, hereinafter referred to as Free Consultation" define the rules for free of the "Oversec Contact Form" available on the Oversec website (www.oversec.pl, oversec.com.pl, oversec.eu) by the Users, in order to obtain an answer to the question/s in the subject area covered by it.

§2 Definitions

  1. Oversec contact form- a form in which Users of the www.oversec.pl, oversec.com.pl, oversec.eu Websites provide the necessary information and data in order to perform the service/handle the submitted inquiry.
  2. User- a person using the "Oversec Contact Form" to the extent covered by these Regulations.

§3 Determining the rules of Users' access to the "Oversec Contact Form"

  1. Access to the Oversec Contact Form does not depend on the User fulfilling any formalities, in particular, this access does not require the User to register and log in.
  2. Oversec provides Users with free access to the Oversec Contact Form for an indefinite period.
  3. The Oversec Contact Form is used only for correspondence related to the activities of Oversec, in the thematic scope specified therein.
  4. The contact form cannot be used for: correspondence as part of specific cases and proceedings conducted by Oversec (initiated or completed), for submitting complaints, petitions, offers, as well as requests for providing information under the Act on Access to Public Information, and questions within the meaning of of the Press Law.

§4 Terms of use of the Oversec Contact Form and User's obligations

In order to use the Oversec Contact Form, the User performs the activities which include:

  • completing the Contact Form by providing the following data and information: name and surname, e-mail address, telephone number, message subject and message content,
  • confirmation that he/she has read the Regulations and accepts all its provisions,
  • consent to the processing of personal data in order to prepare and provide answers to the question(s) and to archive them,
  • confirming the willingness to be contacted back by pressing the "Send message" link (button) contained in the Contact Form .
    1. The User is obliged to use the Oversec Contact Form in accordance with the law, the provisions of these Terms of use and good practices.
    2. The User commits not to provide false personal data, as well as not to provide personal data of another person without their permission and not to provide an e-mail address or telephone number that he/she is not the owner of. The user is solely responsible for the content of the entered data, including liability for any infringement of third party rights.
    3. The User commits to read the changes in these Terms of use.
    4. The User utilizing the "Free Consultation" Oversec Contact Form is entitled to a one-time, free telephone or online consultation, lasting no more than 30 minutes.
    5. In the event of re-subscribing for a free consultation by a User who has already used it in the past, Oversec reserves the right not to conduct a free consultation.

§5 Oversec's liability

  1. Oversec is not responsible for the decisions of the User made on the basis of information obtained as a result of completing the Oversec Contact Form.
  2. Oversec is not responsible for the lack of access to the Contact Form resulting from reasons beyond Oversec's control or other technical reasons related to the functioning of the ICT system and the Oversec Website.
  3. Oversec reserves the right to change the provisions of these Regulations at any time. The changes come into force upon posting the content of the amended Terms of use on the www.oversec.pl Website, in the "Terms of using the Free Consultation contact form" tab.
  4. Oversec reserves the right to stop offering this service at any time, without disclosing reasons.
  5. Oversec reserves the right to refuse carrying out a consultation if it has been ordered by a natural person or an enterprise smaller than 50 people employed under a contract of employment or a cooperation agreement.

§6 Processing of personal data by Oversec

  1. The administrator of personal data within the meaning of art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons' data with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation GDPR) is OVERSEC Sp. z o. o. with its registered office in Gdańsk at Reduta Wyskok 4, 80-741 Gdańsk, Poland, entered into the Register of Entrepreneurs of the National Court Register (KRS) kept by the District Court Gdańsk-North in Gdańsk, 7th Commercial Division of the National Court Register under the number KRS 0000932648, NIP 5833440228, REGON 520455198.
  2. The User's personal data is processed on the basis of the consent expressed by the data subject by unchecking the appropriate box on the Oversec Contact Form.
  3. The following personal data of the User are processed: name, surname, e-mail address, telephone number.
  4. Providing personal data is voluntary, however, failure to provide it may prevent the User from obtaining a response via the Oversec Contact Form.
  5. These data may be transferred to persons authorized by Oversec - our employees and associates who must have access to the data to perform their duties.
  6. The User has the right to access his/her data and the ability to correct them. Each User also has the right to withdraw consent to the processing of personal data by sending an appropriate request to the following address: kontakt@oversec.pl
  7. The User's personal data may only be made available to:
    • relevant state authorities at their request on the basis of generally applicable laws,
    • other persons and entities - in cases other than those described in §7 section 7, only with prior consent of the data subject.
